    • 1.SELLER IDENTITY

1.1 The seller of the products present in the online catalogue of the website www.inkoffice.it is Ink & Office Srl, with registered office and operational headquarters in Italy – Via Vittoria Colonna 24 00193 Rome. (VAT number and Tax Code: 09186971009).

    • 2. CONCLUSION OF THE PURCHASE CONTRACT

2.1 To place your purchase order, the User must first register as a Customer on the website www.inkoffice.it and then follow the purchase procedure indicated by the system.

2.2 The purchase of the requested items will be completed through the following phases: 1. By sending the order, the customer sends Ink & Office a proposal to purchase the selected products. Sending the purchase order implies consent (pursuant to art. 10 DL 185/1999) to receive subsequent communications to Ink&Office described here, which are aimed exclusively at the conclusion and execution of the sales contract. The customer has 24 hours from placing the order online to communicate any cancellation to Ink&Office, by calling 06.3224066 or by sending an email to dionigi@inkoffice.it. In any case, Ink&Office will verify the actual availability in stock of the requested goods, as well as the accuracy of the proposal and will communicate by telephone, to the number indicated by the customer, or by email, whether the order can be accepted or not. Please note that all Orders will be considered void if the registration card does not include a landline telephone number. 2. If the Order can be accepted, Ink&Office will deliver the requested items to the express courier responsible for delivering to the indicated address. Payment by the customer will be made using the method chosen online at the time of purchase.

2.3 The purchase contract stipulated between Ink&Office and the Customer must be considered concluded with the acceptance, even partial, of the Customer's order by Ink&Office. Acceptance is expressed by means of a confirmation email sent to the email address indicated by the Customer.

2.4 The confirmation message will report the date and time of the order and a “Customer Order Number”, to be used for any further communication with Ink&Office. The message will reiterate all the data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections.

2.5 Once the online purchase procedure has been completed, the Customer will print or save an electronic copy of his/her order and the relative confirmation and in any case will keep the current General Conditions of Sale.

2.6 For each order placed, Ink&Office issues an invoice or receipt for the material shipped, which will be sent either with the delivery of the goods or sent in electronic format via email to the customer's address entered into the system during registration or directly downloadable in the dedicated section on the shop. For the issuing of the invoice, the information provided by the Customer at the time of the order will be valid. No changes to the invoice will be possible after its issuance.

    • 3. SUBJECT OF THE CONTRACT AND ONLINE CATALOGUE

3.1 The subject of these General Conditions of Sale are the products present in the online catalogue of the website www.inkoffice.it .

3.2 The Customer may purchase only the products present and available in this catalogue at the time of placing the order. Ink&Office reserves the right to vary the product catalogue without prior notice.

3.3 If one of the requested products is not available, Ink&Office undertakes to contact the Customer within 10 days from the time of placing the order, communicating by email the unavailability and any alternative solutions. In this case the Customer may wait for the delivery of the order, if Ink&Office believes, at its sole discretion, to be able to find the unavailable product on the market, or cancel the order obtaining the refund of the price already paid.

3.4 All products offered for sale are analytically described (quality, characteristics, price) in the specific online catalogue of the website www.inkoffice.it . The sheet of each product indicates the retail price pursuant to Art. n° 1336 cc and includes VAT and any other tax. Any additional costs (shipping costs, transaction costs) will be displayed in total before the order is sent and will be borne by the customer. They vary depending on the Order and the payment method. All prices indicated within the pages of the website and on the sales documents are expressed in Euro (€).

3.5 The image, possibly present in support of the product description, has a merely descriptive value. The color of the article may be different from that represented by the monitor of your computer also due to the particular calibration configured by the user of the PC.

3.6 Not all products may be supplied with a manual in Italian: the buyer agrees that the manual may also be supplied in a different language.

3.7 Some products may only be supplied with an electrical socket.

    • 4. PAYMENT METHODS

4.1 The goods can be paid for under the following conditions: bank transfer or cash on delivery.

4.2 Whatever form of payment you choose, Ink&Office will contact you to confirm the Order, so we invite you to indicate in the Order form a landline telephone number useful for contacting you.

4.3 Payment by bank transfer must be made within 7 days of the order in favour of "INK & OFFICE SRL" on the following bank details:

«Bank: UniCredit Banca Spa - IBAN IT49O 02008 05229 0000 1107 4461». In the reason for payment, the Customer must indicate the order number and date. If the purchase is made by bank transfer, the order will not be processed until Ink&Office Srl has received a copy of the bank transfer by fax to 06.45503504. The goods will be ready within the expected 48 hours but will not be delivered until that time. The 24/72 hours expected for delivery will therefore start from the moment of receipt of the fax and/or credit in the bank. Our data for making the transfer will be displayed upon confirmation of purchase. If the transfer is made within the expected time, the order will be considered null.

4.4 If you choose to pay for your purchase by cash on delivery, please remember that before your order is processed, you will be contacted by telephone to ensure that your order has been processed. By choosing the cash on delivery payment method, you can make purchases for a maximum of €999.00 including VAT. Payment by cash on delivery has an additional cost of €4.00 of the total value of the order, plus any shipping costs. Please note that upon arrival of the goods, our couriers will accept payment in cash or by bank draft.

    • 5. DELIVERY METHODS AND COSTS

5.1 Ink&Office accepts orders exclusively for delivery in Italy. However, delivery to the locations of Livigno, Campione d'Italia and the Republic of San Marino is excluded.

5.2 Shipping costs vary depending on the weight of the goods!! Basic shipping (from 0 to 3kg) is €7.00 including VAT.

5.3 Orders are shipped via SDA to the delivery address indicated in the order. For any information on transport, you can contact SDA directly by contacting the nearest Operational Point indicating: name, address and city of delivery.

5.4 From the moment the product is collected from the warehouses, the delivery time is generally 24 hours. For bulky, large or heavy products, delivery takes approximately 24 to 48 hours. For shipments to Calabria, Sicily and Sardinia, the delivery time may vary from 48 to 72 hours. If at the time of delivery, the holder of the order is not present at the indicated address, the transport company will leave a notice and will contact the holder of the order to establish the delivery day. For this purpose, it is also possible to contact SDA by telephone by going to the nearest Operational Point indicating: name, address and city of delivery.

5.5 Unless otherwise and explicitly indicated by Ink&Office, delivery is intended to be at street level. Upon delivery of the goods by the courier, the Customer is required to check: that the number of packages delivered corresponds to that indicated in the transport document sent in advance via email; that the packaging is intact, not damaged, not wet or otherwise altered, including the sealing materials (adhesive tape or metal straps).

5.6 Any damage to the packaging and/or the product or the discrepancy in the number of packages must be immediately contested by placing a written reservation for control on the courier's proof of delivery. Once the courier's document has been signed, the Customer will not be able to raise any objection regarding the external characteristics of the delivered goods.

5.7 Any problems concerning the integrity, correspondence or completeness of the products received must be reported within 10 working days of delivery.

5.8 In the event of failure to collect the material stored in the courier's warehouses within 5 working days due to repeated impossibility of delivery to the address indicated by the Customer when ordering, the order will be automatically cancelled and the transport costs will be borne exclusively by the Customer.

    • 6.RIGHT OF WITHDRAWAL

6.1 Only the consumer (i.e. the person who purchases the products for purposes other than any professional or entrepreneurial activity carried out) has the right to withdraw without any penalty and without specifying the reason, within 10 working days of receiving the goods, pursuant to art. 64 paragraph 1 and 65 paragraph 1 letter of Legislative Decree no. 206/2005 (Consumer Code). To exercise this right, the customer must send Ink&Office Srl a communication to this effect, within 10 working days of receiving the goods. This communication must be sent by registered letter with acknowledgement of receipt, addressed to Ink&Office SRL – Via Vittoria Colonna,24- 00193 Rome (RM) or by telegram or fax always sent within the aforementioned term of 10 working days and followed by a confirmation sent by registered letter with acknowledgement of receipt within the following 48 hours. Once the aforementioned communication of withdrawal has been received, Ink&Office Customer Service will promptly communicate to the customer the instructions on how to return the goods, which must take place within the following 48 hours. The right of withdrawal is in any case subject to the following conditions: the right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the product purchased (e.g.: accessories, attached software, etc.); it is an essential and necessary condition, for the purposes of exercising the right of withdrawal, that the goods to be returned are in substantial integrity.

6.2 The right of withdrawal is exercised by sending, within 10 working days of receiving the goods, a written communication addressed to Ink & Office SRL, Via Vittoria Colonna,24 - 00193 Rome (RM), by registered letter with return receipt. The communication can also be sent, within the same term, by telegram, telex, e-mail and fax, provided that it is confirmed by registered letter with return receipt within the following 48 hours; the registered letter is considered sent in good time if delivered to the accepting post office within the terms set out in the code or in the contract, where different. The return receipt is not, however, an essential condition for proving the exercise of the right of withdrawal. If expressly provided for in the offer or in the information concerning the right of withdrawal, in place of a specific communication, the return of the goods received is sufficient provided that this is done within 10 days of receiving the goods. Once the goods have been delivered, the customer is required to return them or make them available to Ink&Office or the person designated by them within 10 days of receiving the goods. It is specified that the term for returning the goods cannot in any case be less than 10 working days from the date of receipt of the goods. After the deadline, the goods are considered returned when they are delivered to the accepting post office or to the forwarder. With reference to the costs incurred by the customer for returning the goods, the customer is required to pay only the direct costs of returning the goods to the sender, where expressly provided for in the contract.

    • 7.AUTHORIZATIONS

7.1 By registering on the website owned by Ink & Office SRL or by purchasing on the website www.inkoffice.it with the relevant registration procedure, the Customer authorizes Ink&Office to communicate non-sensitive personal data (residence, telephone number, other) to the couriers and/or forwarders and/or trusted suppliers used for the delivery of the purchased goods in order to allow the procedures necessary for the delivery of the purchased goods.

    • 8. WARRANTY - GENERAL AND MANUFACTURER-SPECIFIC CONDITIONS

8.1 If a defect is found in the purchased goods, within the first 7 days (natural and consecutive) from the date of delivery, Ink&Office will replace the defective product immediately (subject to technical verification). To use this service, the product(s) must be shipped to our warehouse, exclusively by courier, the costs of which are exclusively borne by the buyer. This service does not include products that have a direct manufacturer's guarantee (printers, monitors, scanners, etc.), components purchased with an assembly service and personal computers and all products whose cost is less than € 100. for which the transport costs are entirely borne by the buyer. Products that, following verification, are found to be functioning, will instead be sent back with an increase in transport costs for the outward and return journey.

8.2 All products sold by Ink&Office are covered by the manufacturer's conventional warranty and, for consumers only, by the 24-month legal warranty for defects of conformity, pursuant to articles 128 et seq. of Legislative Decree no. 206/2005 (Consumer Code). To benefit from warranty assistance, the Customer must keep the invoice that will be received upon delivery of the goods. The manufacturer's conventional warranty is provided in accordance with the methods illustrated in the documentation included in the product packaging. The 24-month warranty pursuant to the Consumer Code applies to products that have a defect of conformity, provided that the product itself is used correctly, in compliance with its intended use and as provided for in the attached technical documentation. This warranty is reserved for private consumers. In the event of a defect of conformity, Ink&Office will, at no cost to the Customer, restore the conformity of the product through repair/replacement or price reduction, up to the termination of the contract. If, following intervention by an Authorized Service Center, the defect does not result in a lack of conformity, the Customer will be charged for any costs of verification and repair requested by the Authorized Service, as well as transport costs if incurred by Ink&Office. The times for replacement or any repair of the product depend exclusively on the manufacturer's policies. In the event that, for any reason, it is not able to provide its customer with a product under warranty (repaired or replaced), Ink&Office may proceed at its own discretion to refund the entire amount paid or replace it with a product of equal or superior characteristics. In cases where the application of the guarantees requires the return of the product, the product must be returned by the Customer in its original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.).

8.3 Shipping costs: after the first 7 days, shipping costs are at the customer's expense. The goods must arrive carriage paid and will be returned carriage forward (costs at the customer's expense).

8.4 Use of the service: the products, always with their original packaging, must be adequately packaged. Ink&Office is not liable for damage resulting from transport from the customer to the service center. The warranty will not be recognized in the event of physical damage to the products or missing parts if the defect is not declared within two days of receiving the package (even by email) and in any case before the product has been installed. Therefore, check the integrity of the products very carefully upon receipt of the package before using the product. The purchase of personal computer components presupposes that the user has the necessary expertise to evaluate the correct combination of components and to correctly assemble the personal computer. Ink&Office is responsible for the correct functioning of each individual component through simple replacement or repair (at the sole discretion of its technicians) and is not liable in any way for any anomalies due to incorrect installation, incorrect combination of components or damage that each component may cause to other parts of the PC, even if purchased at the same time as the component that caused the defect. For storage media (hard disk, etc.), the warranty explicitly excludes the saving and recovery of data owned by the customer and the reinstallation of previously installed software. Where possible, these operations will be carried out for a fee and only upon explicit request by the customer.

8.5 Identification Labels: The products are supplied with one or more labels that define their origin, serial number and warranty date. The removal of even one of these labels voids the warranty because it makes it impossible to recognize them.

    • 9. UNFAIR CLAUSES

9.1 The Customer expressly declares to approve, pursuant to and for the purposes of articles 1341 and 1342 of the civil code, the following clauses: 4. Object of the contract and Catalogue; 6. Delivery methods and costs; 7. Right of withdrawal; 8. Guarantees; 11. Competent court.

    • 10. FAILURE TO COMMUNICATE BY THE SELLER (USED)

10.1 If the seller no longer responds to communications aimed at finalizing the procedure, after 90 days from the moment of receipt of the goods at Ink & Office SRL, the latter will automatically pass to the ownership of the promising buyer company and no payment of the previously agreed amount will be due to the seller.

    • 11. NON-ACCEPTANCE BY THE SELLER (USED)

11.1 If the seller does not accept, due to negligence in filling in the data or failure to communicate malfunctions, the change in the amount of the valuation provided, the return of the goods will be borne by the seller. The return costs amount to €15.00 VAT included for each journey (outward and return) in the case of valuation of smartphones, tablets, smartwatches, laptops, consoles, accessories; or €30.00 VAT included for each journey (outward and return) in the case of valuation of desktop or all-in-one computers, displays.
